Unison secures oral hearing for Judicial Review

The Institute of Employment Rights has been told that Unison’s renewed application for a judicial review against the introduction of Employment Tribunal fees has been accepted.

Following the rejection (on paper) of the union’s previous application for a judicial review, it yesterday signaled it would be calling for an oral hearing. This hearing has been given the green light and will take place on Monday (29 July 2013) – the same day the fees will be introduced.

In a case brought by Fox and Partners law firm in Scotland, a legally-binding undertaking was given to the court stating that if Employment Tribunal fees are found to be illegal after their introduction, the government will be forced to repay all charges to claimants that have been caught under the new law.

Fox and Partners will also be granted a hearing later this year.
